FOGG Alert – October 25, 2010

On Wednesday, October 19, 2010 our Coalition lawyer, Susan Brandt-Hawley and FOGG’s attorney, Sue Hestor, met with two Deputy City Attorney’s to discuss the recent filing of the Coalition’s lawsuit.  Our suit seeks to set aside the recent actions by Planning and Port Commissions to proceed with the Planning staffs Northeast Embarcadero Study, and the Port Commission’s approval of the proposed term sheet for the 8 Washington project.

The City Attorney’s office will consider whether to recommend that the Planning Commission and the Port set aside their actions as requested by the Coalition.  In the meantime our attorneys and the City attorneys are cooperating in constructing the administrative record for the lawsuit, which will be used as the basis for legal briefs to be filed in the case in coming months. There is still much more work to be accomplished.

As you can see there has been a lot of ground work done by the attorneys, and as we said:  “There is still much more work to be accomplished.”

Many of our supporters responded to the FOGG OPEN LETTER of October 16, 2010 by sending in tax deductible donations.

A number were first time donors. We sincerely thank all who heeded our call for financial support. Yet “There is still much more work to be accomplished.”

Your continued financial support will assist us in meeting our goal of preserving the community’s open recreation space.  FOGG and our Coalition partners are providing a sensible plan that impacts the entire community in a positive way, offering many City-wide residents the recreational needs we all cherish in a safe, family friendly environment.  The latest draft will be on our web site next week.

FOGG is taking this opportunity to resend our OPEN LETTER of October 16, 2010 to remind those who are still contemplating a donation that now is the time to participate in the entire FOGG team’s efforts.
